Tip #3: Reduce global contrast
As your images get more refined, it’s easy to lose detail. Reduce the contrast or gamma curve of an image to bring it back to life and give more detail to your images. This technique can be done quickly using the Image > Adjustments > Levels or similar Adjustments dialog box.

Curves

This appeal involves the question of whether the several convictions for possession of marijuana on one’s person which were entered against three defendants are invalid due to the trial court’s failure to give a proper “possession” instruction.

Appellants, James E. Hardy, Jerry R. Murphy, and Ray E. Watts, were charged in a two count indictment returned by a grand jury sitting in the Middle District of Florida and tried together. Count I charged all three defendants with unlawful possession of marijuana with intent to distribute the same in violation of 21 U.S.C. § 841(a)(1). Count II charged all defendants with unlawful possession of marijuana on board the vessel “Texas Star” in violation of 46 U.S.C. § 1903.

After a jury trial, appellants were convicted on Count I only.1 Defendants were acquitted on Count II.

The sole issue before this court is whether appellants were deprived of a fair trial as a result of the trial court’s failure to give a proper jury instruction on the meaning of “possession.” We find that appellants’ convictions on Count I are not valid because the jury was not instructed properly as to the definition of possession. Therefore, we vacate those convictions and remand the case for a new trial.

* Appellants Hardy, Murphy, and Watts were stopped by U.S. Customs officers approximately eight to nine miles off shore from Indian Pass, Florida, on the night of October 21, 1978. At that time, a Customs officer boarded the “Texas Star” and inquired of the captain as to the ship’s course. In response to the captain’s reply that he was on a fishing trip for the night, the officer was told that the captain was not the owner of the boat and that it was not fish or oil.

The captain then informed the officer that the three men on board were in charge and that they had no “authority” to board the boat. The officer then asked the three men to get out of the stern of the boat. He further requested that they move to a place where they could be frisked and their persons searched.
